1. Acceptance Of Terms

These Terms and Conditions ("Terms") govern the relationship between Calista Resort by Mavenco ("the Resort", "we", "us") and any individual, company, or organisation ("the Client", "you") that makes use of our premises, services, or facilities.

By submitting an enquiry, signing an event contract, making a payment, or entering the resort premises, you agree to be bound by these Terms. These Terms apply in addition to any specific event contract signed between the parties; in the event of conflict, the specific event contract shall prevail.

2. Bookings & Reservations

All bookings are subject to availability and are not confirmed until the Resort has issued a written confirmation and the required deposit has been received.

• Tentative holds on dates may be made at the Resort's discretion and are generally held for a maximum of 7 days without a deposit.
• A booking deposit (typically 25–50% of the total estimated event cost) is required to confirm the reservation. The specific amount will be stated in your event proposal.
• The Client is responsible for providing accurate event details at the time of booking. Changes to guest numbers, layout, or scope must be communicated at least 14 days before the event date.
• The Resort reserves the right to refuse any booking at its discretion.

3. Payments & Pricing

All prices are quoted in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Pricing is valid for the period specified in the event proposal and is subject to change without notice for new enquiries.

• A non-refundable booking deposit is required to confirm the date and venue.
• Interim payments and the final balance are due on the dates specified in the event contract.
• Any additional services requested on the day of the event will be billed and must be settled within 7 days of the event.
• Payments may be made by bank transfer, cheque, or such other methods as agreed with the Resort in writing.
• The Resort reserves the right to charge interest on overdue payments at a rate of 2% per month.

4. Cancellation & Rescheduling Policy

The following cancellation terms apply unless specified otherwise in the event contract:

• More than 90 days before the event: Deposit is non-refundable; no further charges apply.
• 61–90 days before the event: 50% of the total contracted event value is payable.
• 31–60 days before the event: 75% of the total contracted event value is payable.
• 30 days or less before the event: 100% of the total contracted event value is payable.

Rescheduling: Requests to reschedule an event must be made in writing. If rescheduling is requested more than 60 days before the original event date and subject to venue availability, no penalty will apply. Rescheduling with less than 60 days' notice is treated as a cancellation and a new booking.

All cancellations and rescheduling requests must be submitted in writing to info@calistaresorts.com and are confirmed only upon written acknowledgement from the Resort.

5. Event Conduct & Responsibilities

The Client is responsible for the conduct of all event guests and vendors on the Resort premises and shall ensure compliance with all Resort rules, local laws, and regulations.

• The Client must notify the Resort in advance of any activities, performances, or displays (including fireworks, drones, pyrotechnics) that require special permissions. Unauthorised activities are prohibited.
• The Resort reserves the right to stop any activity that poses a risk to safety, property, or the comfort of other guests.
• The Client will be held liable for any damage caused to Resort property by guests, vendors, or contractors during the event.
• Music and entertainment must conclude by the times specified in the event contract in accordance with local noise regulations.
• The Resort operates a no-smoking policy within all indoor spaces. Designated smoking areas are available.
• Consumption of alcohol is subject to Resort licensing conditions. The Resort reserves the right to refuse service to guests who appear intoxicated.

6. Limitation Of Liability

To the maximum extent permitted by applicable law, Calista Resort by Mavenco shall not be liable for:

• Any indirect, incidental, special, or consequential loss arising from use of the Resort or any failure in service delivery.
• Loss, theft, or damage to personal property or vehicles of guests or vendors on Resort premises.
• Any injury to persons on the Resort premises, except where caused directly by the Resort's gross negligence.
• Failure to perform obligations due to circumstances beyond the Resort's reasonable control (see Force Majeure clause).

The Resort's total liability to the Client for any claim shall not exceed the total amount paid by the Client for the specific event giving rise to the claim.

7. Intellectual Property & Photography

The Resort may photograph events for use in marketing materials, on our website, and across social media platforms. If you prefer your event not to be photographed by Resort staff, please notify us in writing before the event date.

By hosting an event at Calista Resort, you grant us a non-exclusive, royalty-free licence to use event photographs or videos in which the Resort's venues appear, subject to reasonable privacy considerations.

All Resort branding, logos, and marketing materials are the intellectual property of Calista Resort by Mavenco and may not be used without prior written consent.

8. External Vendors

The Client may engage external vendors (decorators, photographers, entertainment, etc.) subject to Resort approval. All external vendors must:

• Carry appropriate insurance and produce evidence of the same upon request.
• Comply with a venue induction with the Resort's operations team prior to the event.
• Adhere to agreed-upon setup, access, and breakdown schedules.
• Not bring onto the premises any equipment, materials, or substances that are prohibited or that could cause damage.

The Resort is not responsible for the quality of services provided by external vendors. Any disputes between the Client and an external vendor are between those parties.

9. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond that party's reasonable control, including but not limited to: acts of God, fire, flood, pandemic, government action, civil unrest, power failure, or other extraordinary events.

In the event of force majeure, the Resort will use reasonable endeavours to offer an alternative date. If no alternative is agreed, the Resort's liability shall be limited to a refund of monies paid, less any costs already incurred.

10. Governing Law & Disputes

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

The parties agree to attempt resolution of any dispute through good-faith negotiation before initiating formal legal proceedings.

11. Changes To These Terms

The Resort reserves the right to update these Terms at any time. Updated Terms will be published on our website with a revised "Last Updated" date. Your continued use of our services or website constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.
